Terms & Conditions
The following terms and conditions apply to all transactions that take place on this website. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.
SoBe Furniture is committed to your satisfaction. We will work diligently to deliver to you, our valued customer, quality home furnishings at outstanding values, with friendly, knowledgeable and efficient service.
Recycling is important to SoBe Furniture. When we deliver to you, we make sure to collect all packaging used on your merchandise and send it off for recycling.
PREPARING FOR DELIVERY
Each customer is responsible for providing a clear path for delivery, free of impedi-ments. Stairways, elevators, and doorways must be large enough to allow for safe handling of all furniture. Please secure your home for delivery by covering exposed floors with protective material and removing any furniture or objects that may obstruct the delivery path or otherwise create difficulty with the delivery. SoBe Furniture is not responsible for damages that may result from a delivery in which the customer does not prepare their home as specified in these instructions.
For customer pick-up of products, each customer is responsible for providing a safe, spacious vehicle for transport. It is the customer’s responsibility to inspect all pick-up items prior to loading them into their vehicle. If an item is picked up that has a defect, it is the customer’s responsibility to return the item to SoBe Furniture for servicing. SoBe Furniture assumes no responsibility for items that are damaged during transport in a customer’s vehicle.
SOBE REFERRAL PROGRAM
The SoBe referral program allows you, as well a person referred by you, to each receive $50.00 refunded from your respective final purchases, provided that:
1. Your final purchase is at least $1,500.00 and delivery of all merchandise has been accepted
2. The customer you refer makes a purchase at least $1,500.00 and delivery of all merchandise has been accepted
3. The customer you refer makes a purchase within sixty (60) calendar days of your purchase
4. The customer you refer provides your reference number at the time of their purchase
The refund of $50.00 will be generally processed within fifteen (15) business days and will be credited back in the same manner in which you made your purchase. All cash purchases will be refunded as a check and will be mailed to your delivery address, unless otherwise specified.
Unless otherwise specified, new merchandise purchased from SoBe Furniture is subject to our Return/Exchange Policy. At the time of delivery, the customer re-serves the right to refuse acceptance of new merchandise for any reason, NO QUESTIONS ASKED. Once the delivery team has left the premises, or the merchandise has been picked up by the customer, our three-day Return/Exchange Policy becomes effective, under the following conditions:
- A return or exchange must be authorized within three (3) calendar days of the original delivery date;
- Exchanges are subject to a 15% restocking fee of the original retail price of the items being exchanged;
- Exchanges must be for in-stock products of equal or greater value;
- Returns are subject to a 30% restocking fee of the original retail price of the items being returned;
- Returns and exchanges are subject to a $50.00 non-refundable pick-up fee in addition to any restocking fees that may be applied;
- Returns and exchanges are NOT permitted on Special Order Merchandise, Custom Made Merchandise, and/or Floor Model Merchandise;
- Returns and exchanges are NOT permitted on Special Items (defined in the “Special Items” section below), including, but not limited to, the following items: Rugs, Accessories, Wall Art and other Artwork, Lamps, Pillows, Throws, Poufs, and/or Bedding;
- Returns and exchanges are NOT permitted on any merchandise shipped to, delivered to, or otherwise transported out of the following three counties: 1) Miami-Dade County, 2) Broward County, and/or 3) Palm Beach County;
- Any delivery and installation fees paid are NON-REFUNDABLE, even if the merchandise is refused at the point of delivery;
- Mattresses and box springs carry a separate reselection policy listed under the “Mattress Comfort Promise” section;
- All returns and exchanges are subject to the merchandise being returned in its original condition upon delivery. Returns and exchanges are not permit-ted if there is any damage to or stains on the product. Furthermore, ex-changes/returns must be pre-authorized by calling our customer service center at 888.713.SOBE(7623).
SPECIAL ORDER MERCHANDISE:
While a majority of the merchandise that SoBe Furniture offers is subject to our 100% Risk Free Purchase policy and to our standard Return/Exchange Policy (above), to accommodate our most discerning customers, on occasion we will sell merchandise that we do not typically stock. Special Order Merchandise will be identified by SoBe Furniture at the point of sale, and is subject to the following terms and conditions:
- Special Order Merchandise is NON-REFUNDABLE once the order has been placed, even if the merchandise is refused at the point of delivery. NO RETURNS OR EXCHANGES ARE PERMITTED;
- In the event that Special Order Merchandise is sold online without a customer’s prior knowledge, SoBe Furniture will promptly notify the customer. Prior to completing the sale, SoBe Furniture will require the customer to sign a Special Order Merchandise form, whereby the customer agrees to the terms and conditions specified in the Special Order Merchandise section (above). The customer has the right to refuse these terms and conditions. In the event that the customer refuses these terms and conditions, and the customer’s credit card has already been charged, SoBe Furniture will promptly cancel the order and refund full payment to the credit card.
CUSTOM MADE MERCHANDISE:
Custom Made Merchandise is NON-REFUNDABLE once the order has been placed, even if the merchandise is refused at the point of delivery. NO RETURNS OR EXCHANGES ARE PERMITTED.
FLOOR MODEL MERCHANDISE:
Floor Model Merchandise is sold in “AS IS” CONDITION and is NON-REFUNDABLE. Once Floor Model Merchandise has been picked up by the customer or delivered by SoBe Furniture, NO RETURNS OR EXCHANGES ARE PERMITTED. Furthermore, Floor Model Merchandise does not carry any warranties, neither from the manufacturer, nor from SoBe Furniture.
Special Items include, but are not limited, to the following products:
- Wall Art and other Artwork
- Lamps & Lighting
- Pillows & Throws
- Aroma Diffusers & Aroma Oils
All sales of Special Items (listed above) are NON-REFUNDABLE. Once a Special Item has been picked up by the customer, delivered by SoBe Furniture, or shipped directly to the customer’s home, NO RETURNS OR EXCHANGES ARE PERMITTED.
SERVICES & FEES:
Payments made for any and all services or fees are NON-REFUNDABLE. Services include, but are not limited to, interior design services, interior design packages, delivery services, including third party delivery services, and/or any other service performed by SoBe Furniture or by a third party. Fees include, but are not limited to, financing fees, funding fees, delivery fees, pick-up fees, restocking fees, return/exchange fees, and/or any other type of fee assessed by SoBe Furniture.
SoBe Furniture does NOT guarantee a specific result with any services performed.
ORDERS OUTSIDE OF SOUTH FLORIDA & THIRD PARTY DELIVERIES:
SoBe Furniture only delivers to zip codes located in the following three counties: 1) Miami-Dade County, 2) Broward County, and 3) Palm Beach County. Although SoBe Furniture will assist customers who are interested in purchasing furniture for delivery to a zip code outside of the three counties above, SoBe Furniture does not take responsibility for these, or any other, third party deliveries. Moreover, SoBe Furniture’s 100% Risk Free Purchase policy and standard Return/Exchange Policy does NOT apply to shipping addresses or deliveries outside of the three counties mentioned above, nor to any third party deliveries. All merchandise delivered outside of the three counties mentioned above, as well as all merchandise delivered by a third party, is NON-REFUNDABLE. NO RETURNS OR EXCHANGES ARE PERMITTED.
Any payments made for third party delivery services, whether collected by SoBe Furniture or by the third party directly, are NON-REFUNDABLE.
MATTRESS COMFORT PROMISE
SoBe Furniture offers a 15-Day Mattress Comfort Promise which provides our customers with 15 calendar days to exchange their mattress for another mattress of equal or greater value. Exchanges are not permitted after the first seven days of the delivery date due to the fact that it takes a few days to adjust to a new sleep surface. Only one exchange per customer is permitted. Exchange fees are as follows: Twin $100.00, Queen or Full $150.00, King $200.00. The Mattress Comfort Promise is void if there is any damage to or stains on the mattress.
SoBe Furniture’s 100% Risk Free Purchase policy and standard Return/Exchange Policy does NOT apply to Special Order Merchandise, Custom Made Merchandise and/or Floor Model Merchandise. Furthermore, SoBe Furniture’s 100% Risk Free Purchase policy and standard Return/Exchange Policy does NOT apply to shipping addresses or deliveries outside of the following three counties: 1) Miami-Dade County, 2) Broward Country, and/or 3) Palm Beach County.
SoBe Furniture neither grants nor implies any warranties on any products. All warranties provided, if any, are Manufacturer’s Warranties. Warranty paperwork is typically included in the packaging of the product. Many manufacturers who provide a warranty prefer to handle warrant claims directly. Should you need warranty service, we will assist you in contacting the manufacturer. In select cases, SoBe Furniture may assist in providing warranty service. In those cases, SoBe Furniture will charge a fee for warranty administration, as well as freight charges, pick-up fees, and delivery fees, if incurred. SoBe Furniture will refuse warranty claims based on the following:
- Accidental stains caused by any food or beverage, human or pet bodily fluids, grass, grease, ballpoint pen ink, marker, nail polish, nail polish remover, gum, cosmetics, lipstick, and crayon.
- Accidental damage from rips, tears, cuts, burns, and punctures
- Claims made outside the manufacturer's warranty coverage period
In the event a product is listed at an incorrect price due to typographical error or error in pricing due to website glitches or inaccurate discount codes, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges).
